1. Legal Identity & Scope

FARENIO is a digital service marketplace operated by FARENIO Home & Office Cleaning, acting as an intermediation platform between Clients and independent Cleaning Providers.

FARENIO:

• Does not perform cleaning services directly
• Does not employ cleaners
• Acts as a technical, contractual, and payment intermediary

These CGU govern:

• Access to the platform
• User accounts
• Marketplace rules
• Data, compliance, and liability allocation

2. Definitions

• Platform: FARENIO website, applications, and booking systems
• Client: Individual or legal entity booking services
• Service Provider: Independent professional cleaner or cleaning company
• Booking: Confirmed service order via the platform
• Marketplace Fee: Commission retained by FARENIO

3. User Eligibility

Users must:

• Be legally capable under EU law
• Provide accurate identity and tax information
• For professionals: hold valid registration (SIREN/SIRET or EU equivalent)

FARENIO reserves the right to suspend accounts for non-compliance.

4. Marketplace Role & Neutrality

FARENIO:

• Does not guarantee service outcome
• Does not supervise on-site execution
• Does not substitute the legal responsibility of providers

All services are performed under the sole responsibility of the Service Provider.

5. Account Creation & Verification

FARENIO may request:

• Identity verification
• Proof of activity
• Bank details (IBAN)
• Tax residence declaration (DAC7 compliance)

False declarations may lead to immediate suspension.

6. DAC7 – Mandatory Marketplace Disclosure

In accordance with EU Directive (EU) 2021/514 (DAC7):

FARENIO is legally required to:

• Collect seller identity, tax residence, and income data
• Report annual revenues to tax authorities
• Transmit data to the relevant EU Member State

Users expressly consent to this reporting obligation.

7. Payments & Payment Providers

Payments are processed via licensed Payment Service Providers (PSP) (e.g. Stripe).

FARENIO:

• Never stores full card details
• Complies with PSD2 & SCA requirements
• May delay payouts for compliance checks

8. Platform Suspension & Enforcement

FARENIO may restrict access in case of:

• Tax irregularities
• Repeated disputes
• Fraud risk
• Regulatory obligations

Suspension does not affect existing legal obligations.

9. Data Protection (GDPR)

Personal data is processed in accordance with:

• GDPR (EU) 2016/679
• French Data Protection Act

Users retain rights of access, rectification, and deletion.

10. Governing Law & Jurisdiction

These CGU are governed by French law.

Jurisdiction lies with courts of the operator's registered office.

11. Nature of Services

Cleaning services are:

• Provided by independent professionals
• Booked via FARENIO
• Executed at the Client's premises

FARENIO is not a cleaning company.

12. Pricing & Transparency

Prices displayed include:

• Service price
• Marketplace fee
• Applicable VAT (where relevant)

Invoices are issued in compliance with French tax law.

13. Payment Terms

• Payment is due after service completion
• Automatic payment may be triggered within 72 hours
• Failed payments may result in account restriction

14. Cancellation & No-Show Policy

Cancellation conditions depend on:

• Service type
• Time of cancellation
• Provider policy

No-shows may be charged in full.

15. Liability

Service Providers are solely liable for:

• Damage
• Loss
• Non-performance

FARENIO's liability is limited to platform functionality.

16. Private Household Clients

Services may qualify for French personal-services tax credit

• Client must be tax resident in France
• Declaration remains the Client's responsibility

17. Airbnb & Short-Stay Hosts

Short-term rental clients acknowledge that:

• Services are commercial in nature
• Tax credit eligibility may be excluded
• Accurate invoicing is required for accounting

FARENIO disclaims responsibility for host tax obligations.

18. Corporate & Professional Clients

Corporate clients:

• Are not eligible for personal tax credits
• Must ensure deductibility compliance
• Receive professional invoices
• Contracts may include recurring services

19. NOVA Tax Credit Information

1. All services booked via the Platform are provided by independent professional cleaners acting as merchants.
2. Customers pay 100% of the service price.
3. The NOVA-compliant invoice required to benefit from the 50% French tax credit is issued directly by the independent cleaner. FARENIO acts solely as a marketplace intermediary and does not issue invoices for cleaning services.
4. Any reference to a 50% tax credit is provided for informational purposes only.
5. FARENIO does not guarantee eligibility, approval, reimbursement amount, or payment timeline of any tax credit.
6. Tax benefits, where applicable, are granted solely by the French tax authorities, based on the customer's personal tax situation.

20. Complaints & Mediation

Clients may submit complaints via customer support.

In case of dispute:

• Amicable resolution is preferred
• Mediation may be proposed
• Courts retain final jurisdiction

21. Amendments

FARENIO may update these terms to reflect:

• Legal changes
• Regulatory requirements
• Platform evolution

Users will be informed of material changes.

22. Acceptance

By using the platform, users:

• Acknowledge having read these CGU & CGV
• Accept them without reservation
• Agree to DAC7 and tax reporting obligations
